Terms of Service — Kata Dojo AI

Kata Dojo AI (“Denise”, “the App”) is provided by LERNZONE GmbH, Finkenweg 13, 73035 Göppingen, Germany. By using the App you agree to these terms. If you do not agree, please do not use it.
 

1. What Denise is
Denise is a coaching practice tool. It asks questions, gives feedback on your thinking, and lets you rehearse coaching conversations. Its responses are generated by an AI model.
 

2. AI responses can be wrong
AI-generated output can be inaccurate, incomplete or inappropriate. Denise is for learning and reflection. It is not professional advice — legal, medical, financial, psychological or otherwise — and you remain responsible for what you do with it. Check anything that matters before acting on it.
 

3. Who may use it
You must be at least 18 years old. The App is not intended for children and we do not knowingly create accounts for them.
 

4. Your account
Keep your login details to yourself and do not share your account. Tell us at support@lernzone.com if you think someone else has access to it.
 

5. Your content
What you write stays yours, and so do the responses you receive. You give us the permission we need to store, process and display that content in order to run the App for you — nothing more. We do not use your content to train AI models. How we handle your data is set out in our Privacy Policy.
Please do not enter sensitive or confidential information, including health information, information about identifiable third parties, or material your employer or institution treats as confidential.
 

6. How you may not use it
●    For anything illegal, harmful, deceptive or abusive.
●    To infringe someone else's rights.
●    To attempt to reverse-engineer, overload or circumvent the App or the AI models behind it.
 

We may suspend or close an account that breaches these terms.
 

7. Subscriptions and payment
Paid plans are billed through Stripe. Prices and billing intervals are shown before you subscribe. You can cancel at any time, and cancellation takes effect at the end of the period you have already paid for. We do not refund the remainder of a period already begun, except where the law requires it.
 

8. Right of withdrawal for consumers in the EU
If you are a consumer in the EU, you can withdraw from your subscription within 14 days of taking it out, without giving a reason and without any penalty. Write to support@lernzone.com and we will refund what you have paid for the current period. This is in addition to your right to cancel at any time under section 7.
This is the generous version, and it is publishable today with no change to the product. The alternative — a waiver checkbox at checkout, so users who have already used the service cannot claim a full refund — would need code, and for an ongoing subscription its legal effect is doubtful anyway, because the service is not fully performed on day one. At your volume the refund exposure is small. I would leave it as written.
 

9. Availability
We aim to keep Denise available and working well, but we do not promise uninterrupted service. The App depends on providers including Google Cloud and OpenAI, and we may take it down briefly for updates.
 

10. Liability
We are liable without limitation for injury to life, body or health, for intent and gross negligence, and wherever statute makes liability mandatory. For ordinary negligence we are liable only for breach of an obligation essential to the purpose of this agreement, and then only for the damage typically foreseeable in a contract of this kind. Beyond that we are not liable.
This is deliberately narrower than the blanket exclusion in the earlier draft. German law voids sweeping exclusions against consumers, so an over-broad clause protects you less than a moderate one, not more.
 

11. Changes to the App and to these terms
We may change the App, and we may update these terms. If a change materially affects you we will tell you in advance in the App or by email. Continuing to use Denise after a change means you accept the revised terms.
 

12. Ending the agreement
You can stop using Denise and close your account at any time. We may close an account that seriously or repeatedly breaches these terms, and will tell you why.

13. Governing law
German law applies, excluding its conflict-of-laws rules. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring proceedings there.
